INTRODUCTION

This Privacy Policy explains how emptyingthecup (“we,” “us,” or “our”) collects, uses, shares, and protects information when you use our services (the “Services”), including when you:

  • visit https://www.emptyingthecup.com or any website of ours that links to this Privacy Policy (the “Site”);
  • download and use the emptyingthecup mobile application (the “App”); or
  • otherwise interact with us (including via email or our community forum).

By using our Services, you confirm that you are at least 13 years old. If you are between 13 and 17, you confirm that you have permission from a parent or legal guardian to use the Services. If you believe we have collected personal information from a child under 13 (or under the minimum age required by applicable law), contact us at info@emptyingthecup.com.

1) WHAT INFORMATION WE COLLECT

The information we collect depends on how you interact with the Services.

1.1 Information you provide to us

Account information. When you register, we collect your email address, username, and password. You may optionally provide a display name, first and last name, and a profile picture. Passwords are handled by our authentication provider and are not stored in readable form.

Profile picture. If you upload one, the image file is stored on our servers and displayed in the App. Uploading a picture requires access to your device’s photo library; we only access the specific image you select.

Communications. If you contact us by email or through our community forum, we may collect the content of your message and related contact details.

1.2 Information created by using the App

Meditation sessions. When you complete a session, we record its duration, the level or track used, and when it took place. This information powers the statistics, charts, and progress tracking on your profile.

Daily goal. If you set a daily practice goal, we store that value.

Saved tracks and folders. Tracks you save to your playlist, folders you create, and the order you arrange them in.

Listening limits. For accounts on the free tier, we record cumulative listening time and any cooldown timestamps so that usage limits can be applied consistently.

Membership level. Your subscription tier, synchronised from our website, which determines which features are available to you.

1.3 Information stored only on your device

The following is kept entirely on your device and is never transmitted to us:

  • Downloaded audio and artwork. If you download tracks for offline listening, the files are saved in the App’s private storage. You can remove them at any time from within the App’s Settings.
  • A record of which tracks you have downloaded, along with your chosen colour theme and other local preferences.

1.4 Notifications

If you allow notifications, we store a device token supplied by the Expo notification service so the App can display a playback notification while audio is playing. You can revoke this permission in your device settings at any time.

1.5 What we do not collect

  • We do not collect your precise location.
  • We do not access your contacts, camera, microphone, or files other than a photo you specifically choose to upload.
  • We do not use advertising identifiers, serve ads, or share data with advertisers.
  • We do not track your activity across other apps or websites.
  • We do not collect payment card details. Membership purchases are processed on our website by our payment provider, Stripe; we receive only your subscription status. Stripe’s privacy policy: https://stripe.com/privacy
  • We do not sell your personal information.

2) HOW AND WHY WE USE YOUR INFORMATION

We use the information described above to:

  • create and maintain your account, and authenticate you when you sign in
  • display your meditation history, statistics, and progress toward your daily goal
  • remember your saved tracks and playlist arrangement
  • apply listening limits and membership entitlements correctly
  • deliver playback notifications, if you have permitted them
  • respond to you if you contact us for support
  • improve and develop the Services

We do not use your information for automated decision-making or profiling beyond the features described here.

3) LEGAL BASES FOR PROCESSING (EEA, UK, AND SIMILAR JURISDICTIONS)

Where required by applicable law, we rely on one or more of the following legal bases:

  • Consent — you can withdraw at any time
  • Performance of a contract — to provide the Services you have requested
  • Legitimate interests — such as improving the Services and maintaining security, where not overridden by your rights
  • Legal obligations — where we are required to comply with applicable law

4) WHEN AND WITH WHOM WE SHARE YOUR INFORMATION

We may share information with:

  • Service providers who help us operate the Services (listed in Section 5 below). They are permitted to process personal information only on our instructions and for the purposes described in this Policy.
  • Our website and community forum (emptyingthecup.com), which manages memberships and account registration. Your account in the App and on the website are the same account.
  • Business transfers — in connection with a merger, acquisition, or sale of assets, your information may be transferred. We would notify you before your information becomes subject to a different privacy policy.
  • Legal and safety reasons — if required by law, or to protect the rights, safety, and security of our users or the public.

5) THIRD-PARTY SERVICES

We use the following third-party services to operate the App and Site. Each processes data on our behalf:

Google Firebase (Google LLC) — authentication, database, and file storage. Your account details, session history, saved tracks, and profile picture are stored using Firebase services. Google’s privacy policy: https://policies.google.com/privacy

Stripe (Stripe, Inc.) — payment processing for membership purchases made on our website. Stripe handles all payment card data; we do not receive or store card details. Stripe’s privacy policy: https://stripe.com/privacy

Expo (650 Industries, Inc.) — the App is built using the Expo framework. Push notification tokens are handled by Expo’s notification infrastructure. Expo’s privacy policy: https://expo.dev/privacy

emptyingthecup.com — our WordPress-powered website, which handles membership registration and payments. Membership status is synchronised to the App.

Data may be stored and processed in the United States and other countries where we or our service providers operate. Data protection laws may differ from those in your jurisdiction. Where required, we implement appropriate safeguards for international transfers.

We are not responsible for the privacy practices of third-party websites linked from the App or Site. We encourage you to review their policies directly.

6) DATA RETENTION

We retain your personal information for as long as your account is active, and as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.

When you delete your account — which you can do from Settings within the App — your account record, meditation history, saved tracks, and profile picture are removed. Files downloaded to your device are removed when you uninstall the App or clear them from Settings.

When we no longer need information, we delete or anonymise it, or securely isolate it until deletion is possible.

7) SECURITY

We implement technical and organizational measures designed to protect your information, including encrypted connections and access controls on our database. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we take reasonable steps to protect your data and limit who can access it.

8) YOUR PRIVACY RIGHTS

Depending on where you live, you may have rights including access, correction, deletion, portability, objection or restriction of processing, and withdrawal of consent where processing is based on consent.

Within the App, you can:

  • view and correct your account details in Settings
  • delete your account and its associated data from Settings
  • remove downloaded files from Settings
  • withdraw notification permission in your device settings

To exercise any other rights, contact us at info@emptyingthecup.com. We may need to verify your identity before responding.

Canadian residents (PIPEDA). You have the right to access the personal information we hold about you and to challenge its accuracy. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at www.priv.gc.ca.

EEA and UK residents (GDPR). You have the right to lodge a complaint with your local supervisory authority.

California residents (CCPA). You have the right to know what personal information we collect, to request deletion, and to opt out of sale (we do not sell personal information). To exercise these rights, contact us at info@emptyingthecup.com.

Opting out of marketing. If we send marketing communications, you can opt out at any time via the unsubscribe link or by contacting us. We may still send service-related messages even if you opt out of marketing.

9) DO NOT TRACK

Because there is no consistent industry standard for responding to “Do Not Track” signals, we do not currently respond to them.

10) CHILDREN'S PRIVACY

The App is not directed at children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, contact us at info@emptyingthecup.com and we will take steps to delete it.

11) UPDATES TO THIS POLICY

We may update this Policy from time to time. The updated version will be indicated by an updated “Last updated” date at the top and will be effective when posted. If we make material changes, we may provide additional notice in the App or by email.
